Terms and Conditions

The agreement between the Buyer and the Seller can be concluded in two ways.

The Buyer has the right, before placing an order, to negotiate any provisions of the agreement with the Seller, including those altering the provisions of the following regulations. These negotiations should be conducted in writing and addressed to the Seller (Plenty Reasons, Flory Street 9/8, 00-586 Warsaw).

If the Buyer resigns from the possibility of concluding the agreement through individual negotiations, the following regulations and applicable law shall apply.

**REGULATIONS**

**§1 Definitions**

1. Personal Data Administrator: BVTCHER sp. z o. o., Flory Street 9/8, 00-586 Warsaw, VAT ID: 7123329511, REGON: 364632755. The company is registered in the Register of Entrepreneurs under the number KRS 0000661076 at the District Court for the capital city of Warsaw in Warsaw, XII Economic Department of the National Court Register, with a share capital of PLN 25,000.00.

2. Postal address - name and surname or name of the institution, location in the town (in case of towns divided into streets: street, building number, apartment or unit number; in case of towns not divided into streets: name of the town and property number), postal code, and town.

3. Complaint address: BVTCHER sp. z o. o., Flory Street 9/8, 00-586 Warsaw.

6. Personal data - any information relating to an identified or identifiable natural person. Information is not considered to allow the identification of a person if it would require excessive costs, time, or actions.

7. Sensitive data – personal data including information about racial or ethnic origin, political opinions, religious or philosophical beliefs, religious, party or trade union membership, as well as data concerning health, genetic code, addictions, sex life, convictions, penalty and fine judgments, and other judgments issued in judicial or administrative proceedings.

8. Delivery – the type of transport service along with specifying the carrier and cost listed in the delivery price list at "https://www.bezmiesnymiesny.pl/strona/dostawa".

9. Proof of purchase – invoice, bill, or receipt issued in line with the Act on Goods and Services Tax of March 11, 2004, with later amendments and other applicable laws.

10. Product card – a single subpage of the store containing information about a single product.

11. Client – an adult natural person with full legal capacity, a legal person or an organizational unit without legal personality but having the capacity to perform legal actions, making a purchase from the Seller directly related to their business or professional activity.

12. Civil Code – Act of April 23, 1964, Civil Code with later amendments.

13. Code of good practice – a set of rules of conduct, especially ethical and professional standards referred to in Art. 2 point 5 of the Act on combating unfair market practices of August 23, 2007, with later amendments.

14. Consumer – an adult natural person with full legal capacity, making a purchase from the Seller not directly related to their business or professional activity.

15. Basket – a list of products made from products offered in the store based on the Buyer's choices.

16. Buyer – both Consumer and Client.

17. Place of item release – postal address or collection point indicated in the order by the Buyer.

18. Moment of item release – the moment when the Buyer or a third party indicated by them takes possession of the item.

19. ODR internet platform – EU online service operating based on Regulation of the European Parliament and of the Council (EU) No 524/2013 of May 21, 2013, on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC, available at "https://webgate.ec.europa.eu/odr".

20. Payment – method of payment for the subject of the agreement and delivery listed at "https://www.bezmiesnymiesny.pl/strona/platnosci".

21. Entitled entity – entity authorized to out-of-court settlement of consumer disputes according to the Act on out-of-court resolution of consumer disputes of September 23, 2016, with later amendments.

23. Consumer Law – Act on consumer rights of May 30, 2014.

24. Product – the minimum and indivisible

amount of items which can be the subject of an order, and which is given in the Seller's store as a unit of measure when specifying its price (price/unit).

25. Subject of the agreement – products and delivery being the subject of the agreement.

26. Subject of the service – subject of the agreement.

27. Collection point – place of item release not being a postal address, listed in the summary provided by the Seller in the store.

28. UOKiK Register – register of entitled entities maintained by the Office of Competition and Consumer Protection under the Act on out-of-court resolution of consumer disputes of September 23, 2016, with later amendments, available at: "https://uokik.gov.pl/rejestr_podmiot_uprawnionych.php".

29. GDPR - Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

30. Item – a movable item that can or is the subject of the agreement.

31. Shop – the internet service available at "https://www.bezmiesnymiesny.pl", through which the Buyer can place an order.

32. Seller: Plenty Reasons, Flory Street 9/8, 00-586 Warsaw, VAT ID: 7123329511, REGON: 364632755 KRS under number: 0000661076 BANK ACCOUNT: 36 1050 1953 1000 0090 8013 4894.

33. System – a set of cooperating IT devices and software ensuring processing and storage, as well as sending and receiving data through telecommunications networks using a suitable type of terminal device, commonly referred to as the Internet.

34. Delivery time – the number of hours or working days listed on the product card.

35. Agreement – an agreement concluded outside the entrepreneur's premises or at a distance within the meaning of the Act on consumer rights of May 30, 2014, in the case of Consumers, and a sales agreement within the meaning of Art. 535 of the Civil Code Act of April 23, 1964, in the case of Buyers.

36. Defect – both a physical and legal defect.

37. Physical defect – non-compliance of the sold item with the agreement, especially if the item:
a) does not have properties that this type of item should have due to the purpose specified in the agreement or resulting from circumstances or destination;
b) does not have properties that the Seller assured the Consumer of,
c) is not suitable for the purpose of which the Consumer informed the Seller at the time of the conclusion of the agreement, and the Seller did not raise any objections to such its designation;
d) was delivered to the Consumer in an incomplete state;
e) in case of incorrect installation and launching, if these operations were performed by the Seller or a third party for which the Seller bears responsibility, or by the Consumer who followed the instructions received from the Seller;
f) does not have properties that were assured by the manufacturer or its representative or a person who introduces the item to the market within the scope of their business activity and a person who, by placing their name, trademark, or other distinguishing sign on the sold item, presents themselves as the manufacturer, unless the Seller did not know and, judging reasonably, could not have known about these assurances or they could not have influenced the Consumer's decision to conclude the agreement, or if their content was corrected before the conclusion of the agreement.

38. Legal defect – a situation when the sold item is the property of a third party or is encumbered with the right of a third party, and also if the restriction in using or disposing of the item results from a decision or judgment of the competent authority.

39. Order – the Buyer's declaration of intent submitted via the store specifying clearly: the type and quantity of products; type of delivery; type of payment; place of item release, Buyer's data, and aiming directly at the conclusion of an agreement between the Buyer and the Seller.
