GDPR – Information for Contractors

This information is addressed to:

  1. Contractors of BVTCHER sp. z o. o. (hereinafter the "Administrator"), who are natural persons, and
  2. representatives, proxies, employees, and associates of the Administrator's Contractors

(hereinafter collectively "Associates"). Information regarding the processing of personal data of customers of the Plenty Reasons online store can be found here.

By "Contractors," commercial partners, contractors, service providers, suppliers, and subcontractors with whom the Administrator enters into agreements, collaborates, or conducts discussions regarding potential collaboration are meant ("Collaboration"). As part of the Collaboration, the Administrator may process personal data of Associates engaged in this Collaboration. Therefore, the Administrator provides the following information to the Associates:

The Administrator of Associates' personal data is BVTCHER sp. z o. o. with its registered office in Warsaw at Flory 9, apt. 8, 00-586 Warsaw, email: contact@plentyreasons.com.

Processed Data

The processing concerns data such as first name, last name, position held or occupied, business contact details (e.g., email address or phone number), as well as information included in the content of communications conducted in connection with the Collaboration.

The Administrator may obtain Associates' data in various situations related to the Collaboration between the Administrator and the Contractor, for example:

  1. the Associate's data may be provided by the Contractor directly in the Agreement as the data of the person representing the Contractor or the person for current contacts;
  2. the Associate's data may be included in correspondence (traditional or email) between the Contractor and the Administrator;
  3. the Contractor (or the Associate themselves) may provide the Administrator with the Associate's data for the purpose of contacts between the Administrator and the Contractor;
  4. the Administrator may independently obtain the Associate's personal data from publicly available sources, such as business registers, to verify the information provided by the Contractor.

Providing the Associate's data is voluntary but may be necessary for the conclusion or performance of the Agreement or for undertaking and conducting the Collaboration.

Legal Basis and Purpose of Data Processing

The legal basis for processing the Associate's data is Article 6(1)(f) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("GDPR"), and Article 9(2)(f) of the GDPR, i.e., processing is necessary for the purposes of the legitimate interests pursued by the Administrator, i.e., for conducting the Collaboration, concluding and performing Agreements, and potentially establishing, investigating, or defending claims.

Furthermore, in the case of a Contractor who is a natural person, the legal basis for processing their data is Article 6(1)(b) of the GDPR, i.e., processing is necessary for the performance of a contract to which the Contractor is party or for taking steps at the request of the Contractor prior to entering into a contract.

Recipients of Data

The recipients of the Associate's personal data may be public entities (as separate administrators) if the Administrator is obliged to provide them with data under applicable law.

Additionally, the Associate's data may be disclosed to entities processing data on behalf of the Administrator, i.e., entities providing accounting, auditing services, legal and tax advisory services, providers of standard services related to the circulation and storage of information, hosting services, email services, IT infrastructure, database maintenance services, and other IT services, providers of services related to receivables management and monitoring, including factoring services, debt collection, monitoring of the financial situation of economic entities, business information office services, as well as services related to debt recovery. Data may also be disclosed to authorized employees and associates of the Administrator and entities processing data on its behalf.

Data Processing Period

The Associate's personal data will be processed by the Administrator for the entire duration of the Collaboration and after its termination, i.e., until the expiry of the limitation period for any claims arising from the Collaboration, and in the event of such claims becoming apparent, for as long as necessary for their assertion, as well as for the period required by law.

Rights of the Data Subject

The Associate has the right to access their personal data, to rectify them, to request their deletion or to object to processing due to the Associate's specific situation, and to request the restriction of data processing. If the Associate believes that their personal data are being processed unlawfully, the Associate has the right to lodge a complaint with the supervisory authority, which is the President of the Office for Personal Data Protection.
